Conditions for boat rental

  1. You must be 18 years or older to make a booking with GoBoat.
  2. All prices displayed are subject to change without notice before a booking is confirmed.
  3. The person making the booking is classed as the “Renter” in any booking which includes more than one person. You (the Renter) guarentee, that you have the authority to accept these Use Terms on behalf of each member of your group using GoBoat. You will be the primary contact with GoBoat and will accept any communications/correspondence from GoBoat on behalf of your entire party.
  4. At the time of booking, you must provide GoBoat with your contact details.
  5. Otherwise applicable law regarding refunds/returns of online purchases of 14 days, does not apply to boat rental and thus GoBoat bookings. However, please read our cancelation policy below for details on how you can cancel.

Requirements upon arrival

  1. Valid passport or picture ID.
  2. Mobile telephone fully charged is essential onboard. It will have to be switched on during the entire duration of your journey to allow for communication with GoBoat and/or relevant authorities in any case (any emergency).
  3. Confirmation e-mail of your booking.
  4. If you do not appear to possess the correct documentation or do not meet all relevant requirements of these Use Terms, you will not be allowed to rent our boats.

Insurance

  1. Although the boats are insured, the Renter is the primary responsible for any damage to or loss of the boat and its equipment; in case of damage/loss you will have to pay the amount of DKK 4.000 in full or part of depending on the type of damage or loss. The Renter will be held responsible for the actions of the other members in your group as well.
  2. We strongly recommend that you have adequate personal insurance cover in case of injury.

Cancellations Policies

  1. The cancellation policy described in the following sections 2 through 6 apply to all customers who have NOT purchased Cancellation Warranty.
  2. When you trade with GoBoat as a private client, and have not purchased the Cancellation Warranty, you can cancel your purchase up to 72 hours before your reservation starts. 72 hours prior to the reservation starts your purchase becomes non-refundable as the purchase is considered consumed and you acknowledge that you lose your right to a refund.
  3. If you cancel your purchase with GoBoat more than 72 hours before your reservation starts, you can choose to i) receive a voucher with the full amount (valid for 1 year – the date of expiration can be found on the voucher), ii) change the booking date at no cost or iii) receive a refund of your balance within 14 days from the date we received your cancellation. However, you may be charged an administrative fee.
  4. Between 72 and 24 hours before departure you can choose to i) receive a voucher with the full amount (valid for 1 year – the date of expiration can be found on the voucher) or ii) change the booking date at no cost.
  5. To exercise the right to the refund you must notify us of your decision to cancel by an unequivocal statement, e.g. letter sent by email to info@goboat.dk specifying your name, email and the unique booking code for the reservation we have provided to you. In order to receive a voucher with the full amount, you must click the link in your booking confirmation email. Here you can cancel or change your booking. A voucher will be sent to you within minutes.
  6. The deadline for refund is met if you send your notice of cancellation before the cancellation period has expired.
  7. The cancellation policy described in the following sections 7 through 11 only apply to customers who have purchased Cancellation Warranty and fulfill the criteria laid out below in sections 7 through 11.
  8. When you trade with GoBoat as a private client, and have purchased Cancellation Warranty at the same time as your booking, you can cancel your purchase until 4 hours before your reservation starts. 4 hours prior to the reservation starts, your purchase becomes non-refundable as the purchase is considered consumed and you acknowledge that you lose your right to a refund. The Cancellation Warranty does NOT cover fresh food items bought online, e.g. tapas, sandwhiches or shrimp.
  9. You pay a Cancellation Warranty per boat.
  10. To exercise the right to the refund you must fill out this form (Danish or English).
  11. The deadline for refund is met if you submit the form before the cancellation period has expired.
  12. Please note that purchase of Cancellation Warranty is non-refundable. Otherwise applicable law regarding refunds/returns of online purchases within Europe of 14 days, does not apply to this.
  13. The cancellation policy described in the following sections 14 through 15 apply to all customers.
  14. If you are eligible for a refund, the amount will generally be returned automatically to the payment card you originally used to pay the order. Alternatively we will contact you and ask for your bank information. We will then need the following information: (i) name of the bank, (ii) registration number (4 digits), (iii) account number (10 digits).
  15. Please note that gift cards and any kind of vouchers made are non-refundable. Otherwise applicable law regarding refunds/returns of online purchases within Europe of 14 days, does not apply to this.

Accidents

  1. The Renter is responsible for the boat’s safe navigation and for the actions of each member in your party and you must take all reasonable care. No minor aged under 18 may steer the boat.
  2. In the event of damage to or breakdown of the boat rendering it inoperable, regardless of the reason, no responsibility can be accepted by GoBoat for loss of time and any other damages or expenses incurred as a result hereof. GoBoat shall not be responsible for the consequence of any delay, restriction or cancellation of boat rentals arising from repairs or damage or other circumstances beyond its control.
  3. In the case of any accident or damage to the boat: you must notify GoBoat immediately reporting full details and wait for our instructions; no action should be taken on your own initiative. We will take steps to repair the boat as quickly as possible given the circumstances. In situations where it is not possible for GoBoat to repair the boat or remedy the situation immediately GoBoat shall not be responsible for the consequences of delays or cancellation.
  4. In the case of any accident or damage to any other craft or waterway property you must: record the details (name, model, registration number etc.) of any other boat involved with names, addresses of its owner and witnesses (where applicable) and immediately report the fact to GoBoat with full details.
  5. No repairs may be put in hand without GoBoat’s consent; you must wait our instructions.

General

  1. We encourage all guests to wear life jackets during the entire journey.
  2. The boat shall be steered in accordance with the International Regulations for Preventing Collisions at Sea (COLREGS). You must navigate in accordance with current bye-laws and must observe the speed limits at all times. You are only allowed to sail in the area indicated on the map provided by GoBoat. All areas marked as “no-sail” zones on the map and areas not included on the map must not be entered. Always keep as much distance as possible to other vehicles on the water.
  3. It is not allowed to throw trash into the water. You can not take and use on board any gas appliances or portable heaters of any type. Waterpipes and other items with open fire are not allowed on board the boats. Music players and loudly behavior are not allowed on board the boats.
  4. Irresponsible behavior, such as significant consumption of alcohol, is not allowed by any of the persons on board the boats. Consumption of alcohol is strictly forbidden for the persons steering the boat.
  5. You are only allowed to pee on public toilets. It is strictly forbidden to pee on private property areas and/or onboard the boats.
  6. It is mandatory to respect the maximum number of passenger permitted on board the boats to comply with laws and regulations: the number of persons indicated for each boat must not be exceeded.
  7. The boat is never to be left out of sight unless it has been agreed with GoBoat.
  8. At the end of the rental period it is your own responsibility to ensure that you collect all your items of personal belongings from the boats; We accept no responsibility for any items left aboard.
  9. GoBoat is not obliged to cover expenses in case of cancellations due to weather conditions or lack of available boats as a result of theft, damages or the like; in case of bad weather or wind, depending on severity, planned hires may be delayed or cancelled (in this case they will be postponed to an available date).
  10. GoBoat cannot be held responsible for and is not obliged to refund or cover any expenses in case any areas of the harbor is permanently or temporarily shut down due to construction, events or for any other reason.
  11. GoBoat may at its absolute discretion refuse to hand over a boat or terminate the boat rental agreement in advance where, in the opinion of GoBoat, the Renter or any person in the group is likely to cause damage, distress or fails to comply with company rules; in such event GoBoat will be under no obligation to refund any amount.
  12. The boats must not be used for commercial use without prior written permission from GoBoat.
  13. GoBoat may at any time refuse or terminate the rent agreement if the above rules are not followed or if GoBoat deems that it is not safe to rent out boats.
  14. Events with alcohol consumption e.g. bachelor parties are not allowed. GoBoat reserves the right to reject such groups/bookings/events before departure without any refund.

Late Return

  1. In case of delay you are charged DKK 200 (EUR ~28) for every 15 minutes started beyond the agreed duration of the journey.
  2. It is your responsibility to inform GoBoat if the boat is not back before closing time. Is this not done and GoBoat deems it necessary to start a search for the boat the expenses in connection with this is charged to you.

Payment Terms

  1. All prices are incl. VAT.
  2. Payment can be made using the following payment methods: Visa, Visa Electron, MasterCard, Maestro, JCB and American Express as well as Apple Pay and Google Pay.
  3. Boat rental, events and any other items are paid for in advance.

Liability

  1. GoBoat’s liability shall be limited to a maximum amount equal to the fees paid by you under these Terms of Use or if no fees has been received then DKK 1.000.
  2. In no event shall GoBoat be liable, whether in contract or tort, or otherwise for any incidental, indirect, consequential or unforeseeable loss, damage or expense, loss of profits, loss of business, loss of opportunity, loss or corruption of data, however arising, even if advised of the possibility of such loss or damages being incurred.
  3. The remedies provided in these Use Terms are the exclusive remedies of the Parties.

Gowering Law

  1. The laws of Denmark (excluding its conflict of laws provisions) shall govern the construction and enforceability of these Terms of Use. Any action arising under or relating to these Terms of Use shall lie within the exclusive jurisdiction of the Court of Copenhagen.

Consumer Complaints

  1. If you experience errors or defects in the delivery from GoBoat, please feel free to contact us at info@goboat.dk so we can find a satisfactory solution.
  2. If it is not possible to find a solution, we are subject to the Consumer Complaints Act from 1 October 2015, subject to the following alternative dispute settlement body:

GoBoat's Privacy Policy

Personal data

  1. It is important for us to keep your personal data safe and confidential. We have procedures for collecting, storing, deleting, updating and disclosing personal data to prevent unauthorized access to your personal data and to comply with applicable laws.
  2. We ensure fair and transparent computing. When we ask you to provide us with your personal data, we will let you know what personal data we process about you and for what purpose such personal data is being processed. You will receive information about this at the time of collection of your personal data.
  3. The following guidelines describe the types of personal data we collect, how we process such personal data, and who you can contact, if you have any questions or comments about this Privacy Policy.

Costumer data:

  1. When you book a service of GoBoat or otherwise receive GoBoat services, we collect the following customer data about you: first name, last name, phone number, email and IP address. If you buy a gift card you may include the name for the receiver as well – this is not obligatory.

Booking data:

  1. We collect the following data about you: date, start time, end time point, price, amount paid, comments, location (e.g. Copenhagen, Malmö, Aalborg, London etc) (all “Booking Data”). In addition, we will collect information about boat number, the voltage level of the batteries in the boat, and GPS positions of the boat while you sail.

Other Personal Data:

  1. Additionally, we will automatically collect the following data in order to provide the GoBoat service, which may include:IP Address

    OS Name & Version

    Browser Name & Version

    Screen Resolution

    Language (based on headers sent by browser)

    Usage Date & Time

    Usage Flow (e.g. which presentations/slides were opened and in which order, which emails were opened and which links in emails were clicked, duration of time spent on presentations and specific slides etc.)

    Heat map (e.g. tracking of exactly what was clicked during the usage session, including links, images, selected areas of text etc.)

Purpose:

  1. We collect and store your personal data for specific purposes or other legitimate business purposes.
  2. Your personal data is collected and used for:

    - To provide you with GoBoat service information about services offered on or through GoBoat and evaluations of these – the contract between you and GoBoat – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  3. News about GoBoat and to conduct research about GoBoat’s customer base or services – the permission you give GoBoat – as per Article 6 a of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

    - Furthermore, we ask for demographic and interest data which are not obligatory to provide us with when you sign up for our newsletter (birthday, demographic data, your interests etc.). We store this for as long as you are signed up for the newsletter. In all newsletters from us you can at any time withdraw your permission.

  4. To fulfil your reservation and purchase requests and payments including credit checks and collection – the contract between you and GoBoat – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  5. to notify you of technical updates or changes in policy – the contract between you and GoBoat – as per Article 6 b&c of the Data Protection Regulation.

    - Here we collect “Customer data”, “Booking data” to adhere to book keeping rules up to 5 years and “Other personal Data” as described above to improve our services for 1 year.

  6. In case of a contractual agreement between a company (not the employees) and GoBoat, GoBoat can collect the same data as in 2.1, 2.3 and 2.4 based on the basis of legitimate interest.
  7. We may use non-Personal Data to analyse and develop our marketing strategy and further improve GoBoat and our services.

Data Quality:

Required Personal Data

  1. We verify that the personal data we process about you is correct and not misleading. We also make sure to update your personal data on a regular basis. We ask you to provide us with relevant changes to your personal data. You can use the contact details above to notify us of such changes.
  2. Your personal data will always be processed in accordance with good data processing practices (“God Databehandlingsskik”) and in accordance with applicable laws.
  3. Please note that: (1) there might be some latency in deleting this personal data from our servers and back-up storage, and (2) we may retain this personal data if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

Data Quality Policies:

Activation

  1. We collect Personal Data from the Data Subject when you book/activate the service we provide and when you and the Data Subject uses GoBoat.

    Visit on our website:

  2. When you visit GoBoat’s website, we collect “Other personal data” as described above and we also collect non-Personal Data, which is information that by itself cannot be used to identify or contact you, such as demographic information (e.g. age or gender) or usage information (e.g. the browser you are using, the URL that referred you to GoBoat and the areas of GoBoat you visit). We may also supplement the information we collect with information from other sources to assist us in evaluating and improving our Platform and offerings.

    Newsletter:

  3. If you sign up to receive GoBoat’s newsletters, your personal data is registered directly with GoBoat and our email marketing service Mailchimp. If you no longer wish to receive newsletters from GoBoat, you can unsubscribe at the bottom of all emails sent (or by sending an e-mail hereon to info@goboat.dk).
  4. You allow us to create custom audiences in social media based on your email-address through email upload. This is to improve our advertising relevense to you.

    Anonymization:

  5. GoBoat applies anonymization of data from customers for statistic and research purposes, as well as to improve systems, processors and products.
  6. GoBoat irrevocably anonymizes Personal Data in such a way that the Data Subject can no longer be identified after the deletion as described under purpose.
  7. For example, name, address or personal identification number will be replaced by a code, serial number, etc. Codes are assigned randomly and cannot be restored using lists, keys, etc., showing the relationship between the serial number and the actual identification information.

Tranfer:

General

  1. We may disclose Personal Data to other companies or people under any of the following circumstances:

    - If sharing the information is reasonably necessary to provide or otherwise make available GoBoat and any feature of GoBoat or a service that you have requested.

    - If we are required to do so by law, in connection with litigation, to prevent a crime, or to protect personal property, the public, or GoBoat.

    - In connection with a sale or merger with another entity, consolidation, restructuring, sale of company assets, financing or other corporate change, including during the course of any due diligence process or if GoBoat should ever file for bankruptcy or related proceeding.

    - When we otherwise have the Data Subject’s consent to share the information.

    - GoBoat may also share non-Personal Data with third parties (e.g. aggregate or demographic data).

Disclosure For Legal Reasons

  1. We disclose Personal Data to companies, organizations or individuals outside of our group of companies if we believe in good faith that access, use, preservation or disclosure is necessary to: (1) comply with applicable law, regulation, legal process or enforceable governmental request, (2) enforce applicable user terms, including investigation of potential violations, (3) register, prevent or otherwise protect against address fraud, security or technical issues, or (4) indemnifying us, our users or the public’s rights, property or safety, as required.

Data Subject Rights:

Objection

  1. You have the right to object to our processing of your personal data. You can also object to our disclosure of your personal data. You can use the contact information at the top of the Privacy Policy to send an objection to us. If your objection is justified, we will stop any processing of your personal data.

Insight, Etc.

  1. If you contact GoBoat, GoBoat will inform you of what personal data of you GoBoat is processing, the purpose of the processing, who receives the personal data and the information om where from the personal data originates. We will reply to your request as soon as possible. If your request has not been answered within 4 weeks of receipt, GoBoat will inform you of the reason for this and when a decision is expected to be available. Any inquiry about the above will only be answered if more than 6 months have elapsed since your last request unless you can demonstrate a particular interest in getting the information earlier.

Correctness of Data

  1. The processing of your personal data will be organized so that the information can be updated when needed. Information that proves inaccurate or misleading will be promptly rectified or erased. You are responsible for providing us with information to help ensuring the correctness of your personal data.

Right of Access

  1. Upon your written request, we will provide you with information on whether or not we process personal data concerning you. We will also provide you with information on 1) what information is processed, 2) the purposes, 3) the categories of recipients of the personal data and 4) available information about the source of the personal data.
  2. We will provide such information to you within 4 weeks from the date of receipt of your request. If we cannot provide such information to you within the stated 4 weeks after the date of receipt of your request, we will provide you with information of the reason for this and the time when the information is likely to be available.

Sub data processor:

  1. We use third party data processors to perform the technical operation of GoBoat. Sub data processing is carried out within the European Union. One sub processer, MailChimp is in the USA. The contract between GoBoat and MailChimp has included a standard contractual clause based on the requirements by the European Commission (GDPR). Please contact GoBoat for the contract. The database server is hosted in its own isolated environment protected by a firewall, which prevents the data from being directly accessible to any external party. The majority (database & main server) of our data is stored within the European Union, primarily in Ireland.
  2. We use the following sub data provider types:

    - Technical data base provider
    - Email marketing provider
    - Payment processesing provider
    - Heatmap and screen recording provider
    - Statistics and website usage provider

  3. The sub data processors act solely on our instructions which are based on your instructions. The sub data processors have taken the necessary technical and organizational security measures to protect data against accidental or unlawful destruction, loss or alteration and against the unauthorized disclosure, abuse or other processing in violation of applicable law.

Changes:

  1. We may change our Privacy Policy at any given time. As a GoBoat account holder you should review our Privacy Policy regularly. Such changes shall come into force immediately. If you do not agree to the modified Privacy Policy, please stop using GoBoat. In the event of a conflict between this Privacy Policy and the modified terms, the modified terms shall apply. Your continued use of the Services provided by us after the date the modified terms are posted will constitute your acceptance of the modified Privacy Policy.
  2. The latest change of the policy was January 14th 2022.

Supervision:

The Danish Data Protection Agency, inter alia, supervises the compliance with the applicable national regulation on personal data. You can at any time complain to Datatilsynet. The contact information for the Danish Data Protection Agency is:

GoBoat Plus (DK)

Brug

  1. Der skal altid bookes på forhånd via www.goboat.dk for at benytte medlemskabet.
  2. For at gøre brug af de i medlemskabet specificerede rabatsatser skal de tilsendte voucherkoder anvendes i forbindelse med booking.
  3. Medlemskabets fordele, herunder de angivne rabatsatser, gælder kun i sæsonen fra købsdatoen til 31. december samme år. Fra 1. november 2024 er nye medlemskaber gyldige i 12 måneder fra købsdato.
  4. Rabatsatserne gælder kun til leje af både og ikke til add-on produkter og andre produkter i øvrigt med mindre det er specifikt nævnt.
  5. Der må maksimalt bookes 1 båd med “Sølv” medlemskabet per booking.
  6. Der må maksimalt bookes 2 både med “Guld” medlemskabet per booking.
  7. Der må maksimalt bookes 3 både med “Platin” medlemskabet per booking. 
  8. Man kan maksimalt have én medlemsbooking per dag.
  9. Ejeren af medlemskabet (personen hvis navn der er angivet på medlemskabet) skal være til stede under tjek ind og under alle sejladser, som er booket med medlemskabet.
  10. Der skal fremvises billedeidentifikation i forbindelse med tjek ind, som bevis på at ejeren af medlemskabet er til stede under sejladsen. 
  11. GoBoat forbeholder sig retten til at anmode om at se billedelegitimation fra ejeren af medlemskabet under og efter sejladsen. 
  12. GoBoat forbeholder sig retten til annullere bookingen i tilfælde af at ejeren af medlemskabet ikke er til stede, ikke kan eller ønsker at forevise gyldigt billedeidentifikation i forbindelse med tjek ind, under eller efter sejladsen. I sådanne tilfælde refunderes, flyttes eller ombyttes beløbet for bookingen ikke.

Afbestilling & Gyldighed

  1. Medlemskabet kan ikke returneres eller ombyttes og refunderes ikke.
  2. Afbestilling, ombytning og refundering af individuelle bookinger følger GoBoats generelle vilkår.
  3. Medlemskabet er gyldigt fra købsdatoen til 31. december samme år, hvorefter det ophører uden nærmere orientering. Gældende fra 1. november 2024 er nye medlemskaber gyldige i 12 måneder fra købsdato.
  4. Vi kontakter dig efterfølgende for at tilbyde medlemskab til det følgende år.

  1. 30% rabat i hverdage.
  2. 10% rabat i weekender.
  3. Månedlig inspiration og rabatter fra samarbejdspartnere.

Fordele "guld" medlemskab

  1. 45% rabat i hverdage.
  2. 20% rabat i weekender.
  3. Månedlig inspiration og rabatter fra samarbejdspartnere.
  4. 75% rabat på din fødselsdag.

Fordele "platin" medlemskab

  1. 55% rabat i hverdage.
  2. 25% rabat i weekender.
  3. Månedlig inspiration og rabatter fra samarbejdspartnere.
  4. 75% rabat på din fødselsdag.
  5. Forkøbsret ved udvalgte events.
  6. Gratis forplejningskurv 3x om året.

75% på din fødselsdag

  1. Gælder kun “Guld” og “Platin” medlemskaber.
  2. Rabatten gælder kun til én båd i maksimalt 3 timer. Rabatten gælder kun til bådudlejning – ikke andet.
  3. Rabatten kan kun benyttes på ejeren af medlemskabets fødselsdag.
  4. For at benytte denne rabat skal du kontakte GoBoat via denne formular.
  5. Hvis der ikke er ledige både på den pågældende dato, kan rabatten ikke bruges
  6. En booking foretaget med denne rabat refunderes, flyttes eller ombyttes ikke. Dog kan bookingen flyttes, hvis GoBoat aflyser sejladsen, fx pga. vejret.

Månedlige inspiration og rabatter fra samarbejdspartnere

  1. Gælder for alle typer af medlemskaber.
  2. GoBoat er forpligtet til at udsende 4-5 medlemsmails i løbet af sæsonen.
  3. GoBoat er i øvrigt ikke på nogen forpligtet til udsende yderligere materiale.

Gratis forplejningskurv

  1. Gælder kun “Platin” medlemskaber.
  2. GoBoat tilbyder 3x forplejningskurv per medlemskab.
  3. Der tilbydes maksimalt én forplejningskurv per booking.
  4. Forplejningskurven indeholder normalt en pose chips, en vand og en lakridspibe til hver person, der sejler med i bookingen. Samt en flaske vin til deling. 
  5. GoBoat forbeholder sig retten til at udskifte en eller flere varer i forplejningskurven uden varsel.
  6. Forplejningskurven skal bestilles minimum 48 timer før bookingen. Bestilling kan kun gøres via denne formular.

GoBoats generelle vilkår er til enhver tid gældende.
